Terms of Service

1. The Service

The Service provides a single API endpoint through which you can call published third-party large language models using OpenAI- or Anthropic-compatible request formats. Available models, context specifications and prices are listed publicly on the model catalog page and may change as upstream providers change.

2. Accounts

• You must be at least 18 years old and register with a valid email address. You are responsible for all activity under your account, including every request made with your API keys.
• Keep your API keys confidential. If you suspect a key has been exposed, revoke it in the console immediately and contact us.
• Do not create multiple accounts to circumvent credits, promotional grants or limits.

3. Credits, billing and payment

• The Service is prepaid: you add US-dollar credits to your account, and each request is deducted in real time at the per-million-token input and output prices published in the model catalog.
• Top-ups are completed through a third-party payment provider (for example Creem), which acts as the merchant of record, charges you and issues the receipt. Your purchase is also subject to that provider's terms. The minimum top-up is $5.00.
• Purchased credits do not expire. We may grant promotional credits to your account; promotional credits may carry an expiry date and cannot be withdrawn or refunded.
• A request reserves an estimated amount when it starts and settles at actual usage when it completes. Requests interrupted by client cancellation, network failure or timeout may still incur upstream cost and are billed for the usage actually consumed.
• Prices may change as upstream providers change theirs. Updated prices take effect once published in the model catalog and never apply retroactively to completed requests.
• If you dispute a charge, contact us within 30 days of the charge appearing in your ledger.

4. Refund policy

• Unused purchased credits are eligible for a full refund within 14 days of the top-up. Email support@funcd.org with the order ID. Refunds are returned to the original payment method; timing depends on the payment provider and your bank.
• Consumed credits, promotional credits and credits already transferred to an affiliated service are non-refundable.
• If your account is terminated for violating these Terms, remaining credits are not refunded.
• Duplicate charges or billing errors caused by a fault in the Service will be credited back or refunded after verification.

5. Acceptable use

You agree not to use the Service to:

• Engage in any activity that violates applicable law, including generating illegal, infringing, defamatory, fraudulent or malicious content;
• Violate the usage policies of the upstream model providers;
• Attempt to bypass rate limits, credit limits or security measures, or to reverse engineer, load-test or disrupt the Service;
• Resell, rent or white-label the Service as a whole to third parties without our written permission;
• Upload malware or use the Service to attack other systems.

We may restrict, suspend or terminate the Service if we detect violations, and we reserve all other remedies.

6. Content and intellectual property

• You are responsible for the input you submit through the API and warrant that you hold the necessary rights. To the extent permitted by law, you own the output generated for you; you are responsible for evaluating its accuracy and suitability.
• The Service itself, including the website, documentation, console and branding, is our intellectual property. You receive a limited, non-exclusive, non-transferable licence to use it.

7. Availability and changes

We use commercially reasonable efforts to keep the Service available but do not guarantee uninterrupted or error-free operation. Upstream providers may change or retire models; we may adjust, suspend or remove the corresponding models and will give notice where practical. We are not responsible for the availability, output quality or policy changes of upstream providers.

8. Disclaimer and limitation of liability

The Service is provided "as is". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We are not liable for any indirect, incidental, special or punitive damages arising from your use of or inability to use the Service. Our total liability to you is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim.

9. Termination

You may stop using the Service at any time and request account closure via support@funcd.org. We may suspend or terminate your account for material breach of these Terms, fraud or where required by law. On termination your API keys are disabled immediately and unused purchased credits are handled under Section 4.

10. Governing law

These Terms are governed by the laws of Singapore. The parties will first try to resolve any dispute amicably; failing that, the dispute will be submitted to the competent courts of Singapore.

11. Changes to these Terms

We may revise these Terms from time to time. Material changes will be announced in the console or by email and take effect on publication. Continued use of the Service after a revision means you accept the new Terms.
